U.S. officials have approved the prosecution of former presidential candidate John Edwards on the alleged misuse of campaign funds, a source told ABC News.

The funds allegedly were used to cover up an extra-marital affair by the North Carolina Democrat.

The source told ABC Edwards is aware the U.S. Justice Department intends to seek an indictment and the former senator is reviewing his options.

Those could include a plea bargain or a costly trial, ABC said.

Two wealthy supporters allegedly have provided hundreds of thousands of dollars that were used to support and hide Edwards’ mistress, Rielle Hunter, the report said.

Edwards had an affair with the campaign videographer that eventually produced a daughter, Frances Quinn Hunter, now 3, ABC reported.

Legal experts told the network if the case goes to trial, prosecutors would have to prove the intent of the donations was to cover up the affair so it would not affect Edwards’ 2008 run for the presidency.

ABC said the government’s case is expected to lean heavily on the testimony of Andrew Young, a former aide close to Edwards who falsely claimed paternity of the child before the Iowa caucuses.

Last year, Edwards acknowledged the child is his but has denied he broke any laws.
